About Representative Actions

Representative actions, sometimes called representative proceedings, are the legal mechanism that makes class actions possible in Australia. They allow one or more people to bring a case on behalf of a larger group who share similar issues.

What Is a Representative Action?

A representative action is a type of court proceeding where:

  • A lead plaintiff (or a small group) files a claim;
  • That claim is treated as covering all other group members with similar claims;
  • Group members don’t usually need to appear in court or file individual claims unless they choose to.

This system is designed to ensure that the legal process is manageable and efficient for both the courts and the participants.

Key Features

  • Representative Plaintiff: One person represents the group and gives instructions to the lawyers.
  • Group Definition: The court defines who is included (for example, “all customers charged a certain fee between 2018 and 2022”).
  • Opt Out System: In Australia, individuals are automatically included in the group unless they formally opt out by a set deadline.
  • Court Supervision: Any settlement or resolution must be approved by the court to ensure it is fair and reasonable for all members.

Why It Matters

  • Efficiency: It avoids the need for thousands of separate cases on the same issue.
  • Protection: Courts safeguard group members by reviewing settlements and legal costs.
  • Participation: People can benefit from the outcome without the time and expense of running their own case.

Representative Actions vs. Class Actions

In Australia, “class action” is the common term, but “representative action” is the technical description used in legislation. They refer to the same process, though in practice “class action” is better known to the public.

At Class Justice, we explain both terms clearly so participants can understand how they work. Whether called a class action or representative action, the goal is the same: giving people collective strength to hold powerful organisations to account.
