This Management Agreement applies to all individuals who register as class members through the Class Justice website (classjustice.com.au). By submitting a registration of interest, you agree to be bound by the terms set out in this Agreement.
1. Purpose and Scope
Class Justice manages participants who register through this site. Management may involve:
- Running class actions initiated by Class Justice (“Badged Actions”); or
- Adding registered participants to class actions managed by other firms, funders, or representatives (“Other Actions”).
This Agreement governs the management relationship between Class Justice and registered participants.
2. Services Provided
For the management fee, Class Justice will:
- Collect, verify, and securely maintain participant registrations;
- Communicate with participants regarding case developments, deadlines, and settlement distribution;
- Liaise with law firms, litigation funders, courts, and other relevant parties on behalf of participants for administrative purposes;
- Coordinate documentation, declarations, and other required participant inputs;
- Manage data, reporting, and administrative tasks to ensure efficient progression of the action;
- Oversee the fair distribution of proceeds to participants once available; and
- Provide regular updates to participants regarding the status of proceedings and settlements.
These services are in addition to any services provided by law firms, funders, or other parties managing the action.
3. Our Badged Actions
For class actions initiated and managed directly by Class Justice, unless otherwise stated in writing:
- A management fee of 28% of the proceeds available for distribution to class members will be charged.
- This fee will apply after deduction of all expenses, including but not limited to: legal fees, litigation funding fees, insurance costs, expert fees, report fees, accounting fees, taxation-related fees, administration fees, travel expenses, disbursements, stationery, postage, freight, and courier fees.
- The management fee cannot be increased without the consent of the majority of class members, measured by both number and value of claims.
- Nothing in this Agreement prevents Class Justice from being separately paid fees for administrative work and/or reimbursement of disbursements related to the action.
4. Other Actions
For class actions not initiated by Class Justice but where we manage registered participants:
- A management fee of 8% of the proceeds available for distribution to our managed class members will be charged.
- This fee is in addition to any fees charged by law firms, litigation funders, or other parties managing the action that have already been deducted from the gross proceeds.
5. Authority to Act on Behalf of Participants
By registering through this site, you expressly authorise Class Justice to take all actions reasonably necessary to manage your participation in a class action, including (without limitation):
- Liaising with and providing administrative instructions to law firms, litigation funders, courts, and other parties;
- Collecting, consolidating, and transmitting your preferences or instructions to the solicitors or funders, without recommending or selecting between options;
- Consenting to settlements or other resolutions on your behalf where such decisions are taken collectively for the benefit of the class and directed by the Court or appointed solicitors;
- Issuing directions to any payer of judgment or settlement proceeds to deduct and remit the agreed management fee directly to Class Justice prior to distributing any balance to you; and
- Undertaking such further acts and steps as are incidental or necessary to progress and finalise the class action.
This authority is granted on an irrevocable basis and continues for the duration of your participation in the relevant class action.
6. Dealings with Lawyers, Funders and the Court
- Class Justice may communicate with solicitors, litigation funders, and the Court on an administrative and factual basis only.
- Where multiple law firms or funders seek carriage of the proceeding, the Court will decide. Class Justice will not select or recommend one firm or funder over another.
- Class Justice will keep participants informed of such developments and may transmit participants’ preferences, but will not advise on or determine the choice.
7. Participants’ Responsibility for Independent Advice
You acknowledge and agree that:
- All legal advice must be obtained from a qualified solicitor;
- All financial product advice (including in relation to litigation funding arrangements) must be obtained from an appropriately licensed adviser;
- All accounting advice must be obtained from a suitably qualified accountant; and
- All taxation advice must be obtained from a suitably qualified taxation adviser.
It is your responsibility to seek such advice as you consider necessary. Class Justice does not provide legal, financial, accounting, or taxation advice. Any statements or information provided by Class Justice are factual and administrative only. Whether or not you obtain professional advice is entirely your decision and responsibility.
8. Irrevocable Payment Obligation
Your obligation to pay the management fee described in this Agreement arises immediately upon registration through this site.
This obligation is binding and enforceable upon you if there is any net positive financial outcome in the relevant class action, regardless of whether proceeds are paid to you directly or via a third party.
If for any reason the irrevocable authority granted to Class Justice is withdrawn, revoked, or not recognised, you remain personally liable to pay the applicable management fee to Class Justice.
Class Justice may enforce this obligation as a contractual debt against you.
For the avoidance of doubt: if there are no net proceeds available for distribution in a class action, no management fee will be charged and you will have no obligation to make any payment to Class Justice.
9. Acknowledgement
By registering through this site, you:
- Acknowledge and accept the terms of this Management Agreement;
- Authorise Class Justice to deduct its management fee as described; and
- Agree that this Agreement is binding and enforceable in respect of any class action in which you are a registered participant through Class Justice.
