FAQ

Frequently Asked Questions (FAQ)

What is a class action?

A class action is a court case where one or more people (the representative plaintiff) bring a claim on behalf of a larger group of people with similar issues. It allows many smaller claims to be combined into one stronger case.

How do I know if Iโ€™m part of a class action?

Each class action has a definition of who is included, such as customers of a company, employees of a business, or residents of a community. If you fit that description, you are automatically included unless you opt out. Notices and updates are usually sent directly to potential group members or published publicly.

Do I need to pay to join a class action?

No. In Australia, class actions are generally run on a โ€œno win, no feeโ€ or funded basis. Legal costs, funder commissions, and management fees are usually deducted from any settlement or judgment before money is distributed. If there is no successful outcome, you will not be asked to pay.

What does Class Justice do?

Class Justice is an independent platform that provides information about class actions across Australia. We allow individuals to register their interest, stay updated, and in some cases join actions managed directly by us (โ€œBadged Actionsโ€). We also manage registrations for people who wish to be linked into external class actions.

What do we mean by a โ€œBadged Actionโ€?

โ€œBadged Actionโ€ is our own term for class actions that are initiated and managed directly by Class Justice. When you see the Class Justice badge, it means we are actively overseeing the case, from registration and communication through to settlement distribution. Itโ€™s our way of marking actions where participants can expect the highest level of organisation, transparency, and hands-on management from us.

What if I register through Class Justice for an action managed by another law firm?

When you register for a third-party class action through Class Justice, you gain the benefit of ongoing management and support. We make sure your registration is recognised, keep you informed of developments, and ensure you donโ€™t miss critical deadlines. We also help coordinate with administrators when itโ€™s time to distribute compensation, so the process is simple and transparent.

How does Class Justice get paid?

Our role is funded through management fees or cost recovery arrangements that are applied only when a case has a positive outcome. This ensures our interests are aligned with participants โ€” if there are no proceeds, there are no fees.

What happens after I register?

Once you register, we keep your details securely and link you with the relevant class action. You will receive updates, deadlines, and notices by email. When a case settles, we coordinate with the court-approved administrator to ensure you receive your share.

Do I need to appear in court?

No. Only the representative plaintiff (and the lawyers) usually appear in court. Group members generally do not need to attend, unless they are specifically asked to provide evidence.

Can I opt out of a class action?

Yes. In Australia, class actions are โ€œopt out.โ€ If you do not want to be part of a case, you must formally notify the court by the deadline. If you do not opt out, you are automatically bound by the result (settlement or judgment).

Is my information secure?

Yes. We take security seriously and only share your details with law firms, funders, administrators, or courts as necessary to manage your participation. Please see our Privacy Policy for details.

Can Class Justice give me legal advice?

No. Class Justice provides information and management services, but we do not provide legal, financial, commercial, or strategic advice. You should seek independent advice if you need guidance on your specific circumstances.

I found an error or missing case on your site โ€” what should I do?
